This privacy notice aims to explain what personal data we collect from you and how we use it. This privacy notice applies if you: visit Knock’s websites or social media or other web pages located on third-party websites, provide Knock with business contact information, or register to attend any of Knock’s corporate events. This privacy notice also applies if you use Knock’s websites, hosted services, products, applications, and/or content (collectively, the  “Services”) directly or through a Knock customer (for example, on a Knock customer’s website or communication channel).

This privacy notice also applies to Knock’s products and services (collectively, the “Services”) directly or through a Knock customer (for example, on a Knock customer’s website or communication channel).

1. What personal information do we collect?

I. WHEN YOU ENGAGE WITH A BRAND THAT USES OUR SERVICES (“BRAND(S)” OR “CUSTOMER(S)”)

A. Categories of personal information that we process. If you engage with a Brand that uses our Services, we collect and receive certain data, including, information (IP address, operating system, and type of device used) collected via the cookies installed on the Customer’s website (subject to the Customer’s compliance), a transcript of the conversation between you and the Customer, and other information of our Customer’s end users.

If you elect to engage in any communication or engagement session with Knock or any Customer, it is up to you to decide what, if any, information to provide during such session. Depending on your request, it may not be possible for us or our Customer to address all of your questions without further information from you. Nevertheless, if you do not wish to provide certain information, then you should not do so.

B. How does Knock use the personal information? If you engage with a Brand, we use the personal information collected by (or provided by) the Brand to provide our Services to the Brand and as directed by the Brand. We have in place a contract with the Brand.

In certain cases, we collect information that relates to individuals when they are working in their professional or employment capacity and use this information to create professional profiles of individuals and profiles of businesses. We provide this information to our Customers, including, for them to enrich their business-to-business activities.

C. How does Knock collect personal information?

  • Personal information provided by the Brand, or when the Brand allows us to collect it (e.g., when a Brand that has enabled our technologies (Services) on its website and other digital engagement solutions).
  • From publicly available sources and/or as provided by third parties.

Important note: For clarity, in the use case described here, Knock is a Processor, not a Controller, of personal information that we process on behalf of our Customers in order to provide our Services. If you have questions related to how our Customers’ use your personal information, please contact such Customer(s) directly. We are not responsible for the privacy and personal information security practices of our Customers, please review their privacy policies and practices.

II. PERSONAL INFORMATION COLLECTED THROUGH OUR WEBSITE

A. Categories of personal information that we process. If you visit our Website, we collect the following categories of personal information: full name, business contact details, email address, and any other information you chose to provide when you communicate with us (for example, by submitting a contact form, requesting a demo, registering for updates). To the extent that you submit a CV via our careers site, we will collect the provided information, including the CV, uploaded documentation and your contact details.

In addition, our Website automatically collects certain data including IP address, browser type, page view information, referring page, operating system, and device type via automatic means (including cookies, web pixels, and related technologies). For more information about these technologies, please review Section 3 below.

B. How does Knock use the personal information? The personal information will be used for the following purposes:

  • To allow you to make use of our Website, including, (i) if you request a demo, we will use your personal information to process and answer your request for a demo; (ii) to answer your questions and to allow you to communicate with us; (iii) to analyze your use of our Website and to improve our Website; and (iv) to customize your experience.
  • We will also use your personal information (i) to respond to your questions, comments, and other requests for customer support, or information, including information about potential or future services; (ii) to provide you with the Knock's Website; (iii) for internal quality control purposes; (iv) to establish a business relationship; (v) to generally administer the Knock’s Website; and (vi) to identify sources of where leads are coming from.
  • We will use your personal information to market our Website. Such use includes (i) notifying you about offers and services that may be of interest to you; (ii) tailoring content, advertisements, and offers for you, including, targeting and re-targeting practices; (iii) developing and marketing new products and Services, and to measure interest in our Website; (iv) other purposes disclosed at the time you provide information; (v) as you otherwise consent;
  • We use automatic technologies to collect information through the Website, to understand the usage pattern of our Website and for marketing purposes.

C. How does Knock collect personal information? We collect the personal information directly from you (e.g., when provided or submitted by you).

A. Categories of personal information that we process. Full name, email address, company names, log-in details, IP address, usage of our Services, payment information and any other personal information you chose to provide/supply us with.

How does Knock use the personal information?  To provide our Services and to send service related communications (including to analyze your requests and questions regarding the Services), to perform the agreement, to send surveys and to receive feedback about our Services, to analyze the usage of the Services, to monitor the functionality of the Services, to customize your experience and to improve our Services.

Please note that some of the personal information mentioned herein will be used for detecting, taking steps to prevent, and prosecution of fraud or other illegal activity, to identify and repair errors, to conduct audits, to comply with applicable laws and regulations and for security purposes. Personal information may also be used to comply with applicable laws, with investigations carried out by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims. In certain cases, we may or will aggregate or de-identify your personal information and further use it for internal and external purposes, including, without limitation, to improve the Services, testing and training our products and Services and for research purposes. “Aggregated Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our Services or aggregated candidate data (including Customer information). We may use Aggregated Information and/or disclose it to third parties without restrictions (for example, in order to improve our Services and enhance your experience with them).

2. What is Knock’s legal basis for processing personal information (if and when applicable)?

  1. The data subject has given consent to the processing of his or her personal information;
  2. Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
  3. processing is necessary for compliance with a legal obligation to which the controller is subject; and/or
  4. Processing is necessary for the purposes of legitimate interest.

3. Cookies and Similar Technology

3.1. We use cookies and other identification technologies to operate and improve the Website and to enhance your experience. Where these technologies are also used in connection with the Services, they help us operate and improve the Services and enhance user experience.

3.2. Cookies: Cookies are small text files stored on a visitor’s web browser and applications. Cookies are often used to make browsing easier by performing functions such as saving passwords and maintaining lists of personal preferences regarding the use of the Website.

3.3. Knock’s Website uses the below types of cookies.

  • Strictly Necessary Cookies – these cookies are essential to enable you to browse our websites, apps and Services and use the available features.
  • Functionality Cookies – these cookies allow our websites, apps and Services to remember choices you make while browsing, such as geographic location and preferences such as text size and fonts.
  • Performance Cookies – these cookies collect information about how you use our websites, apps and Services. For instance, these cookies track which pages you visit most. This data may be used to help optimize our websites, apps and Services and make it easier for you to navigate within them.

3.4. Other identification technologies that may be used by Knock Services:

  • Pixel tags (also called beacons or pixels) – these are first- or third-party tags installed on (or called by) a webpage or application. Pixel tags can retrieve certain information about your device and browser, including device type, operating system, browser type and version, website visited, time of visit, referring website, IP address and other similar information. Knock uses pixel tags to identify conversions of users on our website and to assess certain website activity or events, such as when a user fills out a form or clicks on a link.
  • Software Development Kits (also called SDKs) – function like pixels and cookies, but operate in the mobile application context where pixels and cookies cannot always function. The application developer can install pieces of code (the SDK) into the application to collect certain information about user interaction with the application and information about the user device and network information.

3.5. First and third-party technologies: We use first-party cookies or other tracking technologies as described above – these cookies or  technologies originate from the same domain as the Website you’re currently visiting i.e. www.knock-ai.com. Knock may also use third-party service providers who are authorized to place cookies, pixel tags, or similar technologies on our Services with our permission. These technologies help us compile metrics and analytics to help improve our Services. Third-party cookies and technologies are covered by the third party’s privacy notice.

3.6. How to Control Cookies. Web browsers are usually set to accept cookies. However, if you prefer not to receive cookies, you can modify your settings in most web browsers to accept or deny cookies or to request your permission each time a site attempts to set a cookie. Note that if you choose to disable cookies, not all functionality offered by Knock will be available or will work as effectively for you. 4. Sharing of personal information collected

4.1. Business transfers We may share or transfer personal information in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, sale of company assets, bankruptcy or insolvency event, or other transaction or proceeding involving the transfer of some or all of our business or assets. In such cases, personal information may be transferred as part of the business assets.

4.2. Through our Brands/Customers. Brand you have engaged with through the Services. If you engage with a Brand, that Brand shares your personal information with us. Knock may share this personal information with its sub-processors in accordance with our agreement with the Brand. If you have engaged with a Brand, you can contact the Brand to learn more specific information regarding the relevant sub-processors they are utilizing, including with our Services.

4.3. For legal reasons. We may share your personal information if we reasonably believe that it: (i) is necessary to comply with a  legal process (such as a court order, subpoena, or search warrant) or other legal requirement of any  governmental authority; (ii) is necessary to investigate and prevent unauthorized transactions or  other illegal activities; and/or (iii) is otherwise necessary or appropriate to protect our rights or property or the rights or property of any person or entity.

4.4. Service providers. We use third-party service providers to assist us in operating our Website and Services. For example, we share personal information with third parties who provide services to us, such as hosting services (e.g., for our Website), analytics services, marketing tools, CRM tools, customer support tools, AI tools and features, and data storage services. These third parties have access, process, and store personal information in the course of providing their services. We may disclose personal information with our lawyers, accountants, auditors and other professional advisors where necessary to obtain legal or other advice or otherwise protect and manage our business interests.

In addition, where a Customer directs us to do so, we may access third-party sources or integrations (such as APIs) to retrieve or receive personal information needed to provide enrichment or other requested functionality. In any such case we implement appropriate legal and technical measures to safeguard your personal information and privacy rights.

4.5. Between the entities of Knock’s group. We share personal information about you with our affiliated companies.

4.6. Prevent illegal activities and fraud. We may use or disclose the personal information to investigate, prevent, or take action regarding illegal activities, suspected fraud, cybersecurity threats, situations involving potential threats to the physical safety of any person, violations of this policy, or as otherwise required or allowed by law and regulations.

5. Your Privacy Rights

5.1. The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by specific laws):

i. You have the right to withdraw consent to the processing, where consent is the basis of processing.

ii. You have the right to request access to your personal information held by us, along with details on how it is processed, subject to certain conditions. You have the right to demand rectification of inaccurate personal information about you. We will promptly correct any information found to be incorrect.

iii. You have the right to object to unlawful data processing under certain conditions.

iv. You have the right to the erasure of past personal information about you (your “right to be forgotten”) under certain conditions.

v. You have the right to demand that we restrict the processing of your personal information, under certain conditions, if you believe we have exceeded the legitimate basis for processing, the processing is no longer necessary, or if you believe your personal information is inaccurate.

vi. You have the right to data portability of personal information concerning you that you provided us in a structured, commonly used, and machine-readable format, subject to certain conditions.

vii. The personal information we collect is not used for automated decision-making and profiling, except for automated processes in the context of marketing. As stated above, you can opt out of direct marketing by contacting Knock directly or by following the instructions through the unsubscribe options in our email messages.

5.2. Process. You can exercise your rights by contacting us at privacy@knock-ai.com. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

5.3. Marketing activities. If you have signed up to receive Knock’s marketing or advertising communications, you may, at any time, opt out of receiving further communications by clicking on the opt-out link at the bottom of a marketing or advertising email you receive. You may also contact us at privacy@knock-ai.com to opt out or to request changes to your personal information.

5.4. Through our Brands/Customers. Because Knock processes personal information on behalf of our Brands/Customers, Brands/Customers are responsible for responding to requests from individuals regarding their personal information (for example, requests to access, review, correct, delete, or transfer personal information, or to withdraw consent, where applicable). If you have interacted with a Brand through the Services, you should submit your request directly to that Brand.

6. How does Knock protect and retain my personal information?

6.1. We use industry standard security measures designed to protect against the loss, misuse and alteration of the personal information under our control. However, please note that we cannot guarantee that the personal information will not be compromised as a result of unauthorized penetration of our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

6.2. Knock retains the personal information for a period of time consistent with the original purpose of collection. Knock may retain the personal information for longer periods when needed for Knock to pursue its legitimate business interests, conduct audits, comply with its legal obligations, resolve disputes, and enforce its agreements.

7. International personal information transfers

7.1. Please note that we may transfer your personal information outside of your country of origin. We will take steps to ensure that your personal information is subject to appropriate safeguards, including, by executing contracts with the recipients and implementing Standard Contractual Clauses (“SCCs”) as approved by the European Commission.

7.2. As mentioned above, we use a limited number of third-party service providers to make our Website and Services available that access, process, or store personal information in the course of providing services. We currently maintain contracts with these third parties requiring their compliance with applicable laws and regulations and restricting their access, use and disclosure of personal information.

8. Children. The Website and Services are not directed to individuals under 18. If you are under the age of 18, you shall not use the Website and Services or provide any personal information to us without a valid parental or legal guardian consent. Knock does not knowingly collect personal information from individuals under the age of 18.

9.1. We recommend that you review this privacy notice periodically, as we may update it from time to time. Your continued use of our Website and Services, as applicable, constitutes your consent to this privacy notice, to the fullest extent permitted by law.

9.2. We are not responsible for and do not control the privacy practices of any of our Customers or any other third party. We encourage you to review the privacy practices of any Customer and/or any third party.

9.3. We enable you to interact with third party websites, mobile software applications and products or services that are not owned, or controlled, by us (each, a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect personal information from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service.
